Please read these Terms of Service ("Terms") carefully before using the Elevator Rescue mobile application ("App," "Service") operated by Tuzzco ("we," "us," or "our").
1. Acceptance of Terms
By accessing or using the Elevator Rescue App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.
2. Description of Service
Elevator Rescue is a professional training and reference tool providing video guides for elevator rescue procedures, manufacturer-specific instructions, door types, interlocks, and related technical content. The Service is intended for use by:
- Elevator technicians
- Rescue personnel
- Service professionals
- Other qualified professionals in the elevator industry
3. Subscription and Payment Terms
Subscription Plans:
- Monthly Plan: $1.99 per month
- Yearly Plan: $20.00 per year
Device Limit:
- Each subscription supports up to 3 devices
- Devices can be added or removed at any time through the app
- Device linking requires email verification
Payment Processing:
- All payments are processed securely through Stripe
- Subscriptions automatically renew unless canceled
- Prices are subject to change with 30 days notice
- Payment failures may result in service interruption
Billing and Renewal:
- Subscriptions renew automatically at the end of each billing period
- You will be charged the then-current rate for your plan
- Renewal charges occur on the same date each billing period
- You are responsible for maintaining valid payment information
4. Cancellation and Refunds
Cancellation:
- You may cancel your subscription at any time
- Cancel via Settings > Subscription in the app
- Or contact us at tuzzolino.general@gmail.com
- Cancellation takes effect at the end of your current billing period
- You retain access until the end of the paid period
Refunds:
- Refunds are generally not provided for partial billing periods
- Exceptions may be made at our sole discretion for technical issues or service failures
- Refund requests must be submitted within 7 days of charge

5. Device Management
Device Linking:
- Link up to 3 devices per subscription
- Device linking requires email verification with a 6-digit code
- Verification codes expire after 15 minutes
- Rate limits apply: 3 codes per hour per email address
Device Removal:
- Remove devices at any time from Settings > Manage Devices
- Removed devices lose access immediately
- Devices can be re-linked at any time while subscription is active
6. User Responsibilities
You agree to:
- Provide accurate and complete information when creating an account
- Maintain the confidentiality of your account credentials
- Use the Service only for lawful purposes
- Not share your subscription access with unauthorized individuals
- Not attempt to circumvent device limits or security measures
- Not reverse engineer, decompile, or disassemble the App
- Not download content for redistribution or commercial purposes
- Not use the Service in a manner that could damage, disable, or impair it
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Tuzzco and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
License:
- We grant you a limited, non-exclusive, non-transferable license to use the App
- License is valid only while your subscription is active
- You may download videos for offline viewing on authorized devices only
- Downloaded content may not be copied, shared, or distributed
Trademarks:
- Elevator manufacturer names and logos are trademarks of their respective owners
- We are not affiliated with, endorsed by, or sponsored by any elevator manufacturer
- All trademarks are used for identification and reference purposes only
8. Content Disclaimer
IMPORTANT: The information provided in the Elevator Rescue App is for educational and reference purposes only.
You acknowledge and agree that:
- Content is provided "as-is" without warranty of any kind
- We do not guarantee the accuracy, completeness, or timeliness of content
- Elevator rescue procedures vary by manufacturer, model, and local regulations
- You are responsible for following appropriate safety protocols and local regulations
- The App is a supplement to, not a replacement for, proper training and certification
- Always consult manufacturer documentation and follow established procedures
- We are not liable for any injuries, damages, or losses resulting from use of the content
9. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- This includes damages for loss of profits, goodwill, use, data, or other intangible losses
- Our total liability shall not exceed the amount you paid in the past 12 months
- These limitations apply even if we have been advised of the possibility of such damages
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of content
11. Service Modifications and Interruptions
We reserve the right to:
- Modify or discontinue the Service at any time
- Update content, features, or functionality
- Perform maintenance that may temporarily interrupt service
- Change subscription pricing with 30 days notice
We are not liable for any modification, suspension, or discontinuance of the Service.
12. Termination
By You:
- You may terminate your subscription at any time as described in Section 4
By Us:
- We may terminate or suspend your access immediately for violation of these Terms
- We may terminate for non-payment or fraudulent activity
- Upon termination, your right to use the Service ceases immediately
- Downloaded content may be disabled or removed
13. Indemnification
You agree to indemnify and hold harmless Tuzzco, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your use of content from the App in rescue operations
14. Governing Law and Dispute Resolution
Governing Law:
- These Terms are governed by the laws of California, United States
- Without regard to conflict of law provisions
Dispute Resolution:
- Any disputes shall first be attempted to be resolved through good faith negotiation
- If negotiation fails, disputes shall be resolved through binding arbitration
- Arbitration shall be conducted under the rules of the American Arbitration Association
- You waive any right to a jury trial or to participate in a class action
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tuzzco regarding the Service and supersede all prior agreements and understandings.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
- Sending an email notification for material changes
Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
